These Terms and the Privacy Policy together constitute an agreement (“Agreement”) between you and Turning Point in connection with your use of the Services (as defined below).
The Agreement applies to a person / organisation whether a client/patient, his/her representatives or affiliates herein referred to as “End-User”, “you” or “User”; or otherwise a user of our services(“you” or “User”).
‘Website’ refers to Turning Point website url www.turningpointcentre.com.
‘Us,’ ‘we’ refer to authorised person from Turning Point organisation.
This Agreement applies to those services made available by us on the website and in person at our premises or on-site by us, which are offered to the Users include the following:
You must be 18 years of age or older to register, use the Services, or consult with us in any manner. By registering, visiting and using Turning Point services or accepting this Agreement, you represent and warrant that you are 18 years of age or older, and that you have the right, authority, soundness of mind and capacity to use the Services available with us and agree to and abide by this Agreement. In case of a minor or mentally ill patient: by consulting with us for services or use of services in any manner you are asserting that you represent the minor/mentally unsound patient and you have the unequivocal right and authority to consult us and take decisions for the minor/mentally unsound patient and warrant that you agree and abide by this agreement. You will furnish date of birth, guardianship papers and mental health records for our scrutiny as proof of your authority.
Any advice, consultations, reports or notes [oral or text], website contents cannot be considered as legal documents and cannot be used to arbitrate, influence or judge such matters as child custody, alimony, property or tenancy rights, occupational fitness or any other requirements by a third party.
The information that is collected by us directly or indirectly from the End-Users shall belong to us. Users are allowed to provide feedback about their experiences with the Practitioner, however, the User shall ensure that, the same is provided in accordance with applicable law and etiquette. User however understands that Turning Point shall not be obliged to act in such manner as may be required to give effect to the content of Users’ feedback.
The contents of the Website, information, text, graphics, images, logos, button icons, software code, design, and the collection, arrangement and assembly of content, Fact Files and Blogs on the Turning Point Website as well as information handouts or ppt slides used for consultations and workshops/seminars (collectively, "Content"), are the property of Turning Point and are protected under law. Turning Point authorizes the User to view and access the aforesaid content available solely for ordering, receiving, delivering and communicating only as per this Agreement. User shall not modify the Content in part or whole. Any attempt to reproduce, display, publicly perform, distribute, or otherwise use the Content should acknowledge authorship of Turning Point and should be done only with the written consent of Turning Point’s authorised person. Copying of the content for any commercial purpose or for the purpose of earning profit will be a violation and we reserve the right to deal with the same under applicable law accordingly. The content used in the website as well as reports and information handouts are meant for informative purposes only, and the authors, website developers and Turning Point are not liable for any legal actions regarding authenticity, veracity, source and applicability of content and do not take any responsibility for any actions or behaviors on the part of users based on interpretation of contents by viewers or users.
In no event, including but not limited to negligence, shall Turning Point, or any of its consultants, therapists or service providers be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use Services. In no event shall the total aggregate liability of the Protected Entities to a User for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from this Agreement or a User’s use of the Website or the Services exceed, in the aggregate Rs. 1000/- (Rupees One Thousand Only).
Turning Point may retain such information collected from Users for Services for as long as necessary, depending on the type of information; purpose, means and modes of usage of such information. Computer web server logs may be preserved as long as administratively necessary.
You agree that this Agreement and any contractual obligation between Turning Point and User will be governed by the laws of India. Any dispute, claim or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement to arbitrate shall be determined by arbitration in Bangalore Urban jurisdiction. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Bangalore. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language.
